Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Haptyk ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License

Haptyk is offered in two tiers:

Free: You receive a perpetual, non-exclusive, non-transferable license to use the free features of Haptyk for personal or commercial use on up to 3 devices you own.

Pro: Upon purchase, you receive a perpetual, non-exclusive, non-transferable license to use all features of Haptyk, including all current and future sound packs, on up to 3 devices you own. The Pro license is activated via a license key provided after purchase.

3. Hardware and Software Dependencies

Haptyk relies on an internal motion sensor (accelerometer) present in certain Apple Silicon MacBooks. Access to this sensor uses undocumented system interfaces that are not officially supported by Apple. As a result:

- Apple may, at any time and without notice, release a macOS update that restricts, modifies, or removes access to this sensor.

- Haptyk's velocity-sensitive features depend entirely on the continued availability of this sensor access. If Apple blocks access in a future update, the velocity detection feature may stop working partially or entirely.

- Haptyk is provided on an "as available" basis with respect to hardware sensor access. We will make reasonable efforts to maintain compatibility with future macOS versions, but we cannot guarantee uninterrupted functionality.

- Your purchase of Haptyk Pro is for the software and features as they exist at the time of purchase. No refund is owed if a future macOS update affects sensor availability, as this is outside our control.

4. Compatibility

Haptyk requires:

- macOS 13.0 or later

- An Apple Silicon Mac with the required internal motion sensor (generally M2 Pro and later MacBook Pro models)

- Accessibility permission for keyboard event capture

Not all Apple Silicon Macs have the required sensor. If your Mac is incompatible, the app will display a compatibility notice at launch. You should verify compatibility using the free version before purchasing Pro.

5. No Warranty

The Software is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or compatible with all hardware configurations or future operating system versions.

6. Limitation of Liability

In no event shall the developer of Haptyk be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or in connection with your use of the Software, regardless of the theory of liability. Our total liability for any claim arising from or related to the Software shall not exceed the amount you paid for the Software.

7. Intellectual Property

Haptyk and its source code are proprietary. Sound packs included with the Software are sourced from third-party MIT-licensed recordings and remain subject to their respective licenses. You may not reverse engineer, decompile, or redistribute the Software.

8. Updates

We may release updates to the Software from time to time. Pro users receive all future updates at no additional cost for the lifetime of the product. We are not obligated to release updates on any schedule.

9. Termination

We reserve the right to terminate your license if you violate these Terms. Upon termination, you must cease all use of the Software and delete all copies.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to its conflict of law provisions.
